PROBOSFOR GAYRİMENKUL YATIRIM İNŞAAT TİCARET LİMİTED ŞİRKETİ INFORMATION NOTICE REGARDING VISUAL/AUDIO RECORDING PROCESSES

This Information Notice has been prepared by Probosfor Gayrimenkul Yatırım İnşaat Ticaret Limited Şirketi (“Probosfor”) in order to inform you, in accordance with the Law No. 6698 on the Protection of Personal Data (“KVKK”) and the relevant legislation, regarding the processing and storage of your personal data.
Your video recordings and audio data, which fall within the category of visual and auditory personal data, are collected through digital imaging systems and processed in accordance with the KVKK and applicable legislation. Such personal data are processed solely for the purposes of ensuring physical premises security and safeguarding legal, technical, and commercial occupational safety, based on Article 5/2(f) of the KVKK (where data processing is necessary for the legitimate interests of the data controller, provided that such interests do not harm the fundamental rights and freedoms of the data subject).
In line with statutory obligations, such data may be transferred to competent public authorities where required by law. A limited number of authorized personnel have access to the recordings, and confidentiality agreements have been executed between such personnel and our Company, under which they undertake to maintain the confidentiality of the data accessed.
The above-mentioned personal data are processed in compliance with the KVKK and relevant legislation, in a manner that is relevant, limited, and proportionate to the purposes for which they are processed. The purpose of carrying out closed-circuit camera monitoring (CCTV) is strictly limited to the purposes specified in this Information Notice.
Accordingly, the areas covered by security cameras, the number of cameras, and the timing of monitoring are determined and implemented only to the extent necessary to achieve the security objectives. Areas that may result in an interference with personal privacy beyond security purposes (such as prayer rooms, restrooms, etc.) are not subject to monitoring.
Probosfor implements the necessary technical and administrative measures to ensure the security of personal data obtained through CCTV monitoring in accordance with the KVKK and relevant legislation. Personal data obtained through camera recordings are retained for a period of 30 days.
Pursuant to the KVKK and applicable legislation, you have the right to:
Learn whether your personal data are processed,
Request information if your personal data have been processed,
Learn the purpose of processing and whether your personal data are used in accordance with such purpose,
Know the third parties to whom your personal data are transferred domestically or abroad,
Request rectification of incomplete or inaccurate personal data,
Request the erasure or destruction of your personal data under the conditions stipulated in the KVKK,
Request notification of rectification, erasure, or destruction to third parties to whom your personal data have been transferred, and
Claim compensation for damages in the event that you suffer harm due to unlawful processing of your personal data.
Application Procedures
You may submit your requests and applications regarding your personal data to Probosfor through the “Data Subject Application Form” by the following methods:
By sending an email to (…) using the email address previously notified to Probosfor and registered in our system;
By submitting a written application in person with a valid identification document;
By sending a signed hard-copy application along with a photocopy of your identification document to the address: Asmalı Mescit Mah. Minare Sk. No:5-9 Inner Door No:1, Beyoğlu – Istanbul;
By sending an email signed with a secure electronic signature or mobile signature to (…);
By sending an email via your Registered Electronic Mail (REM/KEP) address, signed with a secure electronic signature or mobile signature, to (…) (registered electronic mail address).
